Terms & Conditions of Business

Welcome to the ABIOSH website. If you continue to browse and use this website and if you make a purchase through this website, you are agreeing to comply with and be bound by the following terms and conditions, which govern ABIOSH’s relationship with you in relation to this website. If, for whatever reason, you disagree with any part of these terms and conditions, please do not use or make a purchase through our website.

Except as otherwise stated in these conditions all statutory warranties applying to consumers and all warranties, whether express or implied, by operation of law or otherwise, are excluded so far as legally permitted in relation to any purchase which you make from us.

From time to time we may alter these terms and conditions. It is your responsibility to check which terms and conditions apply at any time.

The terms “ABIOSH” and “us” and “we” refer to the owner of the website – The Awarding Body of International Occupational Safety & Health Limited – details below.

The terms “you” and “client” and “customer” refer to the user or viewer of our website.


Age limitation

You may only place an order with us if you are 18 years of age or over. By placing an order with us you promise to us that you are at least 18 years old.

Privacy and our mailing list

We ask all of our clients to opt into receiving email from us. If you sign up to our mailing list we will email you from time to time to send you our newsletter when new products/services are released; and when events are taking place. Should you wish to be removed from the mailing list at any time please follow the ‘unsubscribe’ link at the bottom of our emails. We will never disclose your email address to any other individual or company.


Prices

We’ve tried to make our pricing policy as straightforward as possible. To that end all prices include Value Added Tax (“VAT”) at the level appropriate within the European Community. Purchasers outside the European Community are liable to pay all applicable duties. All prices are subject to change and we retain the right to adjust prices at any given moment. If you have made an order and checked out we will not change the price.


Payment

All transactions are processed in Pounds Sterling.

We accept the following methods of payment:

Security of Payments

Your security is of paramount importance to us. We have selected [Paypal] and their credit card facility [Payments Pro] as our payment and banking partners. All of your payment related information is processed by [PayPal] – we don’t keep or store any card details on our servers. Your card details are verified automatically online by our payment processor, [PayPal].


Intellectual Property and Copyright

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and all images and graphics. Reproduction is prohibited other than with the prior written permission of ABIOSH. ABIOSH always retains copyright and images must not be reproduced without the prior written permission of ABIOSH.  Please contact us directly should you wish to discuss the use of our intellectual property.

 

Availability

If for whatever reason we are unable to supply the item/service which you have ordered we may offer an alternative which you are free to accept or reject. Alternatively, we will make a full refund of any sum paid for the item.

 

Delivery

You are responsible for ensuring that delivery information is accurate and for making arrangements to accept delivery of an item ordered . Risk in any item ordered passes to you upon delivery of the item/service or, where you fail to take delivery, at the time delivery was attempted.

If you have not made any arrangements to take delivery and delivery has been attempted then you will be responsible for any additional delivery charges incurred.

If you are exporting or importing any item, you will be solely responsible for compliance with exporting and importing laws and requirements of the countries to and from which the item is being shipped together with payment of any expenses incurred including any export/import duties, fees, liabilities and tax/duty costs, which may arise.

 

Cancellations and Returns

Please see the [FAQs] for provisions applying to cancellations and returns.

Unless otherwise provided for, refunds will be processed and paid within 30 days of the date that we notify you that a refund will be made. Refunds are paid by the same method that was used when payment was made.

 

Limitation of Liability and Indemnity

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our employees or agents.

We will not in any circumstances be liable for any indirect, incidental or consequential loss or damage, including any economic loss or loss of profit suffered by you or any third party however caused, including as a result of any negligence, breach of contract, misrepresentation or otherwise.

In the event of our breaching any of these Terms and Conditions, the damages and/or compensation which we are liable to pay to you will not in any circumstances exceed the price of the relevant item. 

You will indemnify us against all claims, costs and expenses which we may incur and which arise, directly or indirectly, from your breach of any of your obligations under these Terms and Conditions.

 

General Terms

Waiver – Nothing in these Terms and Conditions and no express or implied waiver by us in enforcing any of our rights against you shall prejudice our right to enforce any of our rights against you at any time in the future.

Force Majeure – We will not be liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to, acts of God, accidents, war, fire, strikes, lock outs, failure of any communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and we will then be entitled to a reasonable extension of our obligations.

Invalidity and severance – Each clause or any part at all of these Terms and Conditions is to be regarded as independent of the others so that, if any clause or any part at all of these Terms and Conditions is found to be unenforceable or invalid, it will be severed and will not affect the enforceability or validity of the rest of these Terms and Conditions.

 

Disputes and Governing Law

Your use of this website and any dispute arising out of such use of the website are subject to the laws of England and the Courts in England shall have sole jurisdiction in resolving any such dispute.
